DRAFT — pending attorney review

Starting draft for the owner and their attorney. It describes how the product works in the current code. It is not legal advice, it does not claim compliance with any law, and it is not in effect.

Terms

Terms of use.

Draft dated October 30, 2026, for [LEGAL ENTITY NAME — TBD] operating Home Offers Plus at https://homeoffersplus.com. These terms are not in effect. They describe the product as the code works today, so an attorney can replace them with a finished agreement. They do not claim compliance with any law.

The service

Home Offers Plus is software for posting a property and collecting cash offers and estimates in one place. Homeowners can list a property. Agents can submit seller-authorized properties, including contracted and off-market ones, and can send a report of the offers on that property. Investors can save a buy-box and submit offers. A market estimate may be shown beside those numbers when a valuation provider is configured.

The product is subscription-only. Homeowners are not charged. Agents and investors pay a monthly subscription. Home Offers Plus does not take a commission on a sale, and it does not take a referral fee. The operator does not take one either.

Accounts

Signup asks for your name, email, and a password of at least 8 characters, plus a role: homeowner, agent, or investor. Agents also enter a license number and a two-letter market. Investors may enter a company name. You are responsible for activity under your login. The password is stored as a hash, not as the password itself.

An administrator of the product can open a session that views the product as another account, to support that account. That session can see the same listings, offers, and messages the account can see. A server log line is written when that starts and when it stops. There is no separate audit table.

Subscriptions

Agents pay $50 per month for Basic or $75 per month for Pro. Pro is the tier that includes a branded client site and open tracking on reports the agent sends. Checkout is Stripe Checkout and starts a 90-day trial. The first 100 agent subscriptions can be flagged as founding pricing. The code does not clear that flag, and it is written so the subscription stays on the founding price.

Investors pay $50 per month. An investor is not billed until a listing matches their buy-box. The code records the time of that first match. If no listing has matched, the billing job is written to extend the trial rather than charge the card.

Homeowners are not sent through Stripe at signup. Agents and investors who have a Stripe customer can update a card or cancel in the Stripe customer portal. Canceling stops future subscription charges. It does not unwind a sale, because the platform is not a party to one.

This draft does not promise a refund. Taxes, if any, are whatever Stripe calculates. Prices above are the amounts in the product today. A later change would apply to new checkouts. Founding subscriptions are a separate price on purpose.

Offers and estimates

A buy-box match creates an indicative estimate from the criteria that investor saved, such as a percent of the asking price and a closing window. That estimate is not a commitment. The investor confirms it to submit an offer. An offer can include an amount, a closing window, and written terms. The other party can accept, decline, or counter. Either side can withdraw while the offer is still open.

Partner estimates are requested only when that integration is configured. Some partners are emailed a property summary instead of returning a number in the product. A number you see can change, expire, or depend on eligibility and a later property review.

Home Offers Plus does not promise that a listing will receive an offer, that an offer will close, or how long any step will take. Accepting an offer inside the product records that choice. It is not itself the deed, the contract, or the closing.

The platform's role

Home Offers Plus is not a real estate brokerage. It is not a party to a purchase, a listing agreement, or any other transaction between users. People who decide to go further do that off the platform.

Optional follow-up about a traditional sale

On a listing, a homeowner can opt in to hear about a traditional listing. The product stores the wording shown at the time, a version id, and the time of the choice. It then emails a designated contact for the platform. The property address and asking price are included. The notice is worded one way when the property's state matches a state configured for that contact, and another way when it does not.

If that contact sends an introduction, the homeowner's name and email are shared only after the homeowner accepts. Until then, declining or ignoring the introduction leaves the cash-offer thread as it was. The homeowner can withdraw an open request. Home Offers Plus does not take a commission or a referral fee for this follow-up.

What you may post

You may post property details, photos, and messages that you have the right to share. Photos may be stored where the image host serves them on a public URL. Do not post information you are not willing to have the other party on that listing see. Agents who send a report enter the client's name and email for that send. You are responsible for having a basis to contact that person.

Do not misuse the product: no attempts to break into another account, no scraping that degrades the service, and no use of the messaging tools to harass anyone. We may suspend access that threatens the service or other people's information. This draft does not spell out a notice period for that.

Liability, disputes, and governing law

The service is provided as it is available. Outages, missing partner connections, and wrong or stale estimates can happen. Home Offers Plus does not warrant uninterrupted access or a particular result.

This draft does not set a damages cap, a warranty disclaimer beyond the sentences above, an indemnification, a governing law, or a court. Those are blank on purpose.

Changes

The published terms, once counsel has approved them, should say how a change is announced and when it applies. This draft has no effective date other than the draft date at the top. Using the product today is not an acceptance of this draft.
